Task
Produce a legal advisory report for a hypothetical shipowner client. The report must address the following scenario:

A laden bulk carrier, under time charter, suffers a catastrophic main engine failure in international waters, resulting in a grounding incident. The casualty causes significant hull damage, pollution in a sensitive marine area, and cargo loss. The shipowner declared General Average. Cargo interests are contesting the declaration, and the coastal state is pursuing criminal charges against the Master for environmental violations.

Your report must:

1. Analyse the legal principles of General Average under the York-Antwerp Rules 2016. Determine the validity of the shipowner’s declaration in this specific casualty context.

2. Examine the liability regimes under the relevant international conventions (e.g., CLC, Bunkers Convention, Nairobi WRC 2007). Identify all potential liable parties and the limitations of liability available to the shipowner.

3. Assess the criminal liability exposure of the Master and Shipowner under international and coastal state law, focusing on the legal basis for the coastal state’s actions.

4. Provide clear, actionable recommendations to the shipowner for mitigating financial exposure and defending against the criminal charges.
