First, the steps outlined in our school policies and procedures would need to be followed. This includes documenting the incident, notifying the appropriate administrators, and contacting the student’s parents. Our primary goal is to resolve issues respectfully and protect students’ well-being.
The student with the Facebook page may argue that off-campus speech is protected under the First Amendment. However, several court cases have established that schools can discipline students for off-campus online speech that causes substantial disruption at school or infringes on others’ rights. As the assigned cases show, Tinker v. Des Moines established that student speech can be regulated if it causes a material or substantial disruption to school activities.
Additionally, in Layshock v. Hermitage School District and J.S. v. Blue Mountain School District, the courts ruled that schools can discipline students for off-campus cyberbullying and harassment if it is reasonably foreseeable to cause a substantial disruption at school. While off-campus speech has some protection, the right to free speech is not absolute – it does not protect speech that interferes with the rights of others or disrupts the learning environment.
In this case, given the allegations of bullying on social media, it is reasonably foreseeable this could spill over and substantially disrupt the learning environment at school. Therefore, our school’s administration would be justified in investigating further and taking appropriate disciplinary action if warranted, while also respecting the student’s due process rights. The safety and well-being of all students must be the top priority.
